At Zamel’s, we are proud to reward our valued customers through the Zamel’s Rewards Club (Program). These Terms & Conditions (Terms) set out how the Program operates, including membership eligibility, Zamel’s Cash, welcome rewards, referral rewards, birthday offers and member promotional offers.
By joining or participating in the Program, you agree to these Terms.
1. Membership Eligibility
1.1 Membership is open to individuals aged 18 years and over.
1.2 Membership is free and is available to individual customers for personal use only. Membership is not available to corporations, partnerships, trusts, businesses, resellers, wholesale customers, staff purchasing under staff discount arrangements, or any other person or entity purchasing primarily for business, resale or commercial purposes, unless Zamel’s agrees otherwise in writing.
1.3 Each member may hold one account only. Duplicate accounts may be merged, suspended or closed by us, acting reasonably.
1.4 Membership is personal to the individual member and must not be transferred, shared, sold, assigned or pooled with another person’s membership, account, rewards, purchases or Zamel’s Cash.
1.5 Membership may be obtained online through Zamel’s website, in-store, or by any other enrolment method made available by Zamel’s from time to time.
1.6 Members must provide and maintain accurate information reasonably required to administer their Program Account, including their name and a valid email address or mobile telephone number. A member must promptly update information that changes.
1.7 Program Benefits may be issued or displayed electronically, including through a member’s Program Account. A member who does not provide the information reasonably required to administer a particular benefit may be unable to receive that benefit.
Consent to receive Marketing Communications is separate from membership. A member is not required to consent to Marketing Communications to join or remain in the Program, earn or redeem Zamel’s Cash, or access an earned or issued Program Benefit.
1.8 A member may close their membership at any time by contacting Zamel’s Customer Relations at customerservice@zamels.com.au or using another account-closure method made available by Zamel’s.
Closing membership:
(a) prevents the member from earning new Program Benefits after the effective date of closure;
(b) does not of itself cancel valid Zamel’s Cash or another Program Benefit already issued to the member;
(c) does not affect rights or remedies that accrued before closure; and
(d) is separate from withdrawing consent to receive Marketing Communications.
Unless membership is terminated under clause 13 for substantiated fraud or deliberate misuse, valid Zamel’s Cash held when membership is closed may be redeemed until the later of:
(i) its existing expiry date; and
(ii) 30 days after the effective date of closure.
Zamel’s may retain a limited-access Program Account for that redemption period and for record-keeping, fraud prevention and legal compliance purposes.
1.9 Zamel’s may decline an application, temporarily suspend a Program Account or terminate membership only in accordance with clause 13.
2. Program Overview
2.1 The Program rewards members for shopping with Zamel’s by providing:
- a welcome reward for eligible new members;
- Zamel’s Cash on eligible purchases;
- referral rewards for eligible successful referrals;
- birthday offers; and
- member-only promotional offers or vouchers from time to time.
2.2 The Program does not have membership tiers unless Zamel’s introduces tiers by updating these Terms or publishing separate terms.
2.3 Program benefits are promotional loyalty benefits only. They are subject to these Terms and to any additional terms stated on a particular voucher, offer, communication or promotion.
2.4 Program benefits are not legal tender, are not redeemable for cash, are not negotiable instruments, are not financial products, are not purchased gift cards, and cannot be purchased, topped up, reloaded, transferred, sold or exchanged, except where expressly permitted by Zamel’s.
3. Definitions
3.1 In these Terms:
Eligible Purchase means a completed purchase from Zamel’s, in-store or online, that is eligible to earn Zamel’s Cash under clause 5.
Eligible Spend means the final transaction value attributable to eligible goods and actually paid by the member after all discounts, vouchers, promotions and other credits have been applied, excluding any amount paid using Zamel’s Cash and any amount excluded under clause 4.
Marketing Communication means an email, SMS or other electronic communication that advertises or promotes Zamel’s, its goods, services, offers or promotions. It does not include a Service Communication that contains no advertising or promotional content.
Member means an individual accepted by Zamel’s as a member of the Program.
Program Account means the account maintained by Zamel’s for a member in connection with the Program.
Program Benefits means any benefit provided under or in connection with the Program, including Zamel’s Cash, welcome rewards, referral rewards, birthday offers and tactical promotional vouchers.
Service Communication means a communication reasonably necessary to administer a member’s Program Account, transaction or relationship with Zamel’s, including a communication about account security, a purchase, delivery, Zamel’s Cash balance or expiry, a change to these Terms, fraud prevention, a product recall or a legal notice.
Zamel’s Cash means promotional store credit issued by Zamel’s to a member under the Zamel’s Rewards Club, including credit earned on Eligible Purchases and credit issued as a referral reward.
Zamel’s, we, us or our means The Jewellery Group Pty Limited trading as Zamel’s.
4. Eligible Spend and Exclusions
4.1 Unless otherwise specified by Zamel’s, members may earn Zamel’s Cash on completed retail purchases of jewellery and watches from Zamel’s stores or the Zamel’s website.
4.2 Zamel’s Cash is calculated on the final transaction value paid by the member after all discounts, vouchers, promotions and other credits have been applied, and excluding any amount paid using Zamel’s Cash.
4.3 Unless otherwise specified by Zamel’s, the following are not eligible to earn Zamel’s Cash:
- Extended Care Plans or similar care plans;
- repairs, resizing, servicing, cleaning or insurance-related services;
- gift card purchases, gift card redemptions, or any other stored value products;
- shipping, delivery or handling fees;
- lay-bys, deposits, back orders, suspended sales or incomplete transactions until the relevant purchase is completed and recognised by Zamel’s as eligible;
- cancelled, reversed, refunded or fraudulent transactions;
- transactions made using staff discount, wholesale pricing, commercial pricing, or other excluded discount arrangements unless approved by Zamel’s; and
- any other products, services, channels or transactions stated by Zamel’s to be excluded from the Program.
4.4 Members must identify themselves as Program members at the time of purchase, including by logging into their online account or providing the relevant account details in-store. Zamel’s Cash may not be added retrospectively where a member failed to identify themselves, except where Zamel’s agrees, acting reasonably, on proof of purchase and account ownership.
4.5 All calculations of eligible spend, Zamel’s Cash and Program Benefits are based on Zamel’s records, subject to correction for manifest error, refund, return, fraud, misuse or technical issue.
5. Earning Zamel’s Cash
5.1 Subject to these Terms, members earn Zamel’s Cash equal to 5% of Eligible Spend on each Eligible Purchase.
The amount earned in a transaction is subject to the $500 maximum in clause 5.4.
Zamel’s may offer a higher promotional earn rate from time to time. Any promotional rate, eligible period, exclusions and applicable earning cap will be stated in the relevant offer terms.
5.2 Example: if a member has Eligible Spend of $250, the member earns $12.50 in Zamel’s Cash.
If a member has Eligible Spend of $12,000 at the standard 5% rate, the amount calculated before the cap is $600. Because clause 5.4 applies, the member earns $500 for that transaction.
Examples are illustrative only and do not alter the operation of these Terms.
5.3 Zamel’s Cash is calculated on Eligible Spend. Members do not earn Zamel’s Cash on:
(a) an amount paid using Zamel’s Cash; or
(b) a product, service, fee or transaction excluded under clause 4.
5.4 The maximum amount of Zamel’s Cash that may be earned in a single transaction is $500, unless the specific terms of a promotion expressly state a higher cap.
The cap applies separately to each completed Eligible Purchase. A member’s total Zamel’s Cash balance may exceed $500 as a result of multiple Eligible Purchases or other Program Benefits.
5.5 Zamel’s Cash will be calculated to the nearest cent and issued after the transaction has been completed, recorded and verified by Zamel’s.
Zamel’s may temporarily delay issuing Zamel’s Cash while a transaction is pending or while Zamel’s undertakes reasonable payment, fraud, return or eligibility checks.
Zamel’s may withhold, reverse or cancel Zamel’s Cash only where:
(a) the relevant transaction is cancelled, reversed or refunded;
(b) the transaction was not an Eligible Purchase;
(c) the Zamel’s Cash resulted from a manifest calculation or system error; or
(d) clause 13 applies.
5.6 Zamel’s Cash cannot be:
(a) redeemed for cash;
(b) transferred to another person;
(c) sold, assigned or exchanged;
(d) used to purchase gift cards;
(e) applied retrospectively to a completed transaction;
(f) used to pay an excluded fee or charge unless Zamel’s expressly permits it; or
(g) used after its expiry date, subject to clauses 12, 16 and 17.
6. Expiry of Zamel’s Cash
6.1 Zamel’s Cash expires 60 days from the date of issue, unless a longer period is stated by Zamel’s.
6.2 Each amount of Zamel’s Cash has its own issue date and expiry date. Where multiple amounts of Zamel’s Cash are held by a member, Zamel’s may apply the amount of Zamel’s Cash with the earliest expiry date first..
6.3 The expiry date or validity period will be made available to members through their account, on the relevant voucher or communication, or by another method determined by Zamel’s.
6.4 Expired Zamel’s Cash will be forfeited and will not be extended, reinstated or exchanged, except where required by law or where Zamel’s agrees, acting reasonably.
6.5 Zamel’s Cash is a promotional loyalty benefit issued without separate monetary consideration. It is not a purchased gift card or purchased store-value product.
7. Redeeming Zamel’s Cash
7.1 Members may redeem available Zamel’s Cash on future eligible purchases from Zamel’s in-store or online.
7.2 There is no minimum spend requirement to redeem Zamel’s Cash, unless a particular offer, voucher or promotion expressly states otherwise.
7.3 Zamel’s Cash may be used on eligible Zamel’s products but cannot be used to purchase gift cards. Zamel’s may also exclude Zamel’s Cash redemption on specified products, services, fees, promotional items or sales channels, provided those exclusions are disclosed at or before the time of redemption.
7.4 Zamel’s Cash is applied at checkout like store credit. Subject to system functionality, members may redeem all or part of their available Zamel’s Cash. Any unused Zamel’s Cash remains available until its expiry date.
7.5 Zamel’s Cash cannot reduce the transaction value below $0. No cash, change, refund or residual payment will be provided for any unused or excess Zamel’s Cash applied to a transaction.
7.6 Zamel’s Cash cannot be applied retrospectively to a completed transaction.
7.7 Zamel’s may decline, suspend or reverse redemption of Zamel’s Cash where Zamel’s reasonably suspects fraud, misuse, system error, unauthorised account access, account manipulation, breach of these Terms, or any other improper conduct.
8. Welcome Reward
8.1 Eligible new members may receive a welcome reward of $20 off their first purchase when they spend $100 or more in one transaction.
8.2 The welcome reward is available to new members only and may be redeemed once per member.
8.3 To receive the welcome reward, a new member must:
(a) satisfy the membership eligibility requirements;
(b) create a Program Account;
(c) provide a valid email address or mobile telephone number reasonably required to administer the account; and
(d) satisfy any other eligibility requirement prominently disclosed before enrolment.
Consent to receive Marketing Communications is not required to receive the welcome reward. If the member has separately consented to Marketing Communications, Zamel’s may send a promotional reminder about the welcome reward through the consented channel.
8.4 The welcome reward applies to eligible purchases of jewellery and watches only, and excludes Extended Care Plans, repairs, gift cards, shipping, delivery fees and any other exclusions stated on the relevant voucher or communication.
8.5 The welcome reward:
- is single-use only;
- is non-transferable;
- must be redeemed in one transaction;
- cannot be redeemed for cash;
- cannot be used to purchase ECP, Repairs & gift cards;
- cannot be applied retrospectively;
- cannot be combined with other offers, vouchers or promotions unless Zamel’s states otherwise; and
- is valid for the period stated on the relevant voucher or communication or, if no period is stated, for 60 days from the date of issue.
8.6 Zamel’s may withhold or cancel a welcome reward where the person:
(a) has previously held a Program Account or received a welcome reward;
(b) creates or uses a duplicate account;
(c) provides materially false information;
(d) is not eligible for membership; or
(e) has engaged in conduct to which clause 13 applies.
Withdrawing consent to Marketing Communications does not cancel a welcome reward already issued.
9. Referral Reward
9.1 Zamel’s may make a referral offer available under which an existing member can receive Zamel’s Cash when an eligible new member joins the Program and completes their first Eligible Purchase.
9.2 Zamel’s may provide an existing member with a unique referral code, link or QR code.
Zamel’s will not require the existing member to enter a friend’s or family member’s email address, mobile telephone number or other contact information into a Zamel’s referral system.
9.3 The existing member may provide their referral code, link or QR code:
(a) in person;
(b) through a one-to-one personal communication to a person who has agreed to receive it; or
(c) by another method expressly approved by Zamel’s.
Members must not:
(i) send referral material using spam, bulk messaging or automated messaging;
(ii) send referral material to a person who has not agreed to receive it or who has asked not to receive it;
(iii) publish referral material on public coupon, cashback or referral-code websites;
(iv) use paid advertising, search-engine advertising or misleading social media content to promote a referral code;
(v) represent that they are employed by, authorised to act for, or officially endorse Zamel’s; or
(vi) make a false, misleading or deceptive statement about Zamel’s, the Program or the referral offer.
9.4 A referral is successful when:
(a) the referred person is at least 18 years old and eligible to join the Program;
(b) the referred person has not previously held a Program Account;
(c) the referred person independently visits a Zamel’s store or website and enters or presents the valid referral code, link or QR code;
(d) the referred person receives the applicable Rewards Club collection notice and independently provides the information required to join;
(e) the referred person separately chooses whether to consent to Marketing Communications;
(f) the referred person completes their first Eligible Purchase;
(g) that purchase is completed, paid for and verified; and
(h) neither person has engaged in self-referral, account duplication, fraud or other misuse.
9.5 Subject to these Terms, the referring member will receive $20 in bonus Zamel’s Cash for each successful referral.
The referring member is not required to make a purchase to participate in the referral offer or receive the referral reward.
9.6 Zamel’s may delay issuing the referral reward for a reasonable period while it verifies the referred person’s eligibility, first Eligible Purchase and compliance with these Terms.
9.7 If the referred person’s first Eligible Purchase is cancelled, reversed, refunded or found not to be eligible, Zamel’s may withhold or reverse the related referral reward.
Any reversal must be limited to the reward arising from that referral.
9.8 Referral Zamel’s Cash expires 60 days after its issue date, unless a longer period is stated in the referral offer.
9.9 Referral Zamel’s Cash cannot be redeemed for cash, transferred, sold, exchanged, used to purchase gift cards or applied retrospectively.
9.10 Zamel’s may investigate suspected referral misuse and take proportionate action under clause 13.
9.11 Zamel’s will not disclose the referred person’s purchase details, contact details or other personal information to the referring member.
Zamel’s may tell the referring member only that:
(a) a referral has qualified;
(b) a referral has not yet qualified; or
(c) a referral reward has been issued, withheld or reversed.
9.12 A referred person’s consent to receive Marketing Communications must be obtained separately from:
(a) acceptance of these Terms;
(b) submission of the referral code; and
(c) creation of the Program Account.
Zamel’s must not pre-select a marketing consent option.
10. Birthday Offer
10.1 Members may receive a birthday offer of $50 off an order of $200 or more during their birthday month.
10.2 To receive a birthday offer, a member must have a valid date of birth recorded in their Program Account before the start of their birthday month.
Consent to receive Marketing Communications is not required for the birthday offer to be made available through the member’s Program Account. Zamel’s may send an email or SMS reminder only through a channel for which the member has separately consented to receive Marketing Communications.
10.3 The birthday offer:
- is issued once per member per calendar year;
- is single-use only;
- is non-transferable;
- must be redeemed in one transaction;
- cannot be redeemed for cash;
- cannot be used to purchase gift cards;
- cannot be applied retrospectively;
- cannot be combined with other offers, vouchers or promotions unless Zamel’s states otherwise; and
- is valid for the period stated on the relevant voucher or communication or, if no period is stated, until the end of the member’s birthday month.
10.4 The $200 minimum spend requirement for the birthday offer excludes gift cards, Extended Care Plans, repairs, shipping, delivery fees and any other exclusions stated on the relevant voucher or communication.
11. Tactical and Member Promotional Offers
11.1 From time to time, Zamel’s may issue member-only promotional offers or vouchers, including spend-and-save vouchers, seasonal offers, birthday promotions, Valentine’s Day offers, Mother’s Day offers, Zamel’s birthday offers, Christmas offers or other tactical promotions.
11.2 Tactical and member promotional offers are discretionary and are not guaranteed to be issued to all members or at any particular time.
11.3 Each tactical or member promotional offer will be subject to the specific terms stated on the relevant voucher, offer, advertisement, email, SMS or webpage, including any minimum spend, validity period, eligible products, excluded products, redemption channel, limit per member, or other condition.
11.4 Unless Zamel’s states otherwise, tactical and member promotional offers:
- are single-use only;
- are non-transferable;
- cannot be redeemed for cash;
- cannot be used to purchase gift cards;
- cannot be applied retrospectively;
- cannot be combined with other offers, vouchers or promotions; and
- expire on the date stated on the relevant offer or voucher.
11.5 If there is any inconsistency between these Terms and the specific terms of a tactical or member promotional offer, the specific terms of that offer apply to the extent of the inconsistency.
11.6 Digital games, jewellery drops, prize promotions, chance-based promotions, trade promotions or similar campaigns are not governed by these Terms unless Zamel’s expressly states otherwise. Separate terms and conditions may apply to those campaigns.
12. Returns, Refunds and Adjustments
12.1 Zamel’s Cash earned on a returned purchase
If all or part of an Eligible Purchase is cancelled, reversed or refunded, Zamel’s may reverse the amount of Zamel’s Cash earned on the cancelled, reversed or refunded amount.
For a partial return, the reversal must be calculated reasonably and proportionately by reference to the amount paid for the returned item after transaction-level discounts and Program Benefits were allocated.
12.2 Zamel’s Cash used on a returned purchase
If a member used Zamel’s Cash in a transaction that is later cancelled, reversed or refunded, Zamel’s will, subject to applicable law:
(a) refund or otherwise return the amount paid using money or another payment method as required by law or the applicable returns policy; and
(b) reinstate the amount of Zamel’s Cash used in relation to the returned goods.
If the reinstated Zamel’s Cash would otherwise have expired, or has fewer than 30 days remaining, it will be valid for 30 days after reinstatement.
12.3 Australian Consumer Law remedies
Where a member is entitled to a remedy under the Australian Consumer Law or another applicable law:
(a) Zamel’s will not make a deduction or adjustment that reduces the remedy below the amount or form required by law;
(b) the member’s use or receipt of a Program Benefit does not reduce their statutory rights; and
(c) Zamel’s may reinstate the Zamel’s Cash component of a transaction unless the law requires a different remedy.
12.4 Change-of-mind returns
A discretionary change-of-mind return is governed by Zamel’s published returns policy and any conditions disclosed before purchase.
Nothing in that policy or this clause limits a right or remedy that cannot lawfully be limited.
12.5 Negative balances
A negative Zamel’s Cash balance may arise only where:
(a) Zamel’s Cash earned from a transaction was used before that transaction was cancelled, reversed or refunded; and
(b) there is insufficient Zamel’s Cash remaining to complete the required reversal.
Zamel’s may offset that negative balance against Zamel’s Cash subsequently earned by the member.
A negative Zamel’s Cash balance:
(i) does not constitute a monetary debt payable by the member; and
(ii) must not be recovered from the member using money or another payment method.
12.6 Errors and corrections
Zamel’s may correct a manifest error in an account balance, eligibility decision, expiry date or transaction record.
Before making a material adverse correction, Zamel’s will, unless urgent action is reasonably required to prevent fraud or unauthorised access:
(a) notify the member;
(b) explain the basis of the proposed correction; and
(c) give the member a reasonable opportunity to provide relevant information.
12.7 Records and review
A member may request an explanation or review of an adjustment by contacting Customer Relations.
Zamel’s will retain sufficient records to explain a material adjustment and will complete the review within a reasonable period.
12.8 Nothing in this clause excludes, restricts or modifies a right, guarantee, remedy or protection that cannot lawfully be excluded, restricted or modified.
13. Fair Use, Investigations and Misuse
13.1 The Program is intended for genuine personal and household purchasing.
13.2 A member must not:
(a) create, control or use duplicate Program Accounts;
(b) provide materially false, misleading or incomplete information;
(c) obtain or attempt to obtain access to another person’s Program Account without authority;
(d) manipulate purchases, returns, refunds, referrals, account balances or Program Benefits;
(e) split, combine or structure transactions for the purpose of improperly avoiding an earning cap, eligibility rule or exclusion;
(f) sell, transfer or commercialise Program Benefits;
(g) use the Program primarily for resale, wholesale or commercial purchasing;
(h) use bots, scripts, automated systems or other unauthorised technical methods in connection with the Program;
(i) engage in fraud, misleading or deceptive conduct, abusive conduct or unlawful conduct; or
(j) knowingly attempt to obtain a Program Benefit to which they are not entitled.
13.3 Where Zamel’s has reasonable grounds to suspect conduct described in clause 13.2, it may temporarily:
(a) suspend the affected Program Account;
(b) restrict the issue or redemption of the affected Program Benefit;
(c) require reasonable proof of identity, account ownership, purchase or eligibility; or
(d) preserve relevant account and transaction records while the matter is investigated.
Any temporary restriction must be no broader and last no longer than reasonably necessary.
13.4 Unless immediate action is reasonably required to protect account security, prevent fraud or comply with law, Zamel’s will give the member:
(a) notice of the concern;
(b) a reasonable summary of the information on which the concern is based; and
(c) a reasonable opportunity to respond before permanent adverse action is taken.
Where immediate action is taken, Zamel’s will provide that information as soon as reasonably practicable afterwards.
13.5 Following an investigation, Zamel’s may take proportionate action, including:
(a) restoring the Program Account or Program Benefit;
(b) correcting or reversing a Program Benefit directly connected with the relevant conduct;
(c) merging duplicate accounts;
(d) issuing a warning;
(e) imposing a reasonable account restriction;
(f) suspending membership for a stated period; or
(g) terminating membership where serious or repeated misconduct is substantiated.
13.6 Zamel’s must not permanently cancel an unaffected Program Benefit merely because another transaction or benefit is disputed, unless cancellation is reasonably necessary to remedy substantiated fraud or deliberate misuse.
13.7 A member may request an internal review of a material adverse decision.
The review will be undertaken by a person who was not the original decision-maker where reasonably practicable. Zamel’s will communicate the outcome and reasons within a reasonable period.
13.8 Nothing in this clause prevents Zamel’s from referring suspected unlawful conduct to a payment provider, regulator or law-enforcement body where permitted or required by law.
14. Privacy and Marketing Communications
14.1 Zamel’s collects and handles personal information in connection with the Program in accordance with applicable privacy laws, the Zamel’s Privacy Policy and any collection notice provided at or before collection.
14.2 Personal information collected for Program administration may include a member’s:
(a) name and contact details;
(b) date of birth;
(c) Program Account and authentication details;
(d) transaction and purchase history;
(e) Zamel’s Cash balance and redemption history;
(f) referral code and referral activity;
(g) preferences and customer-service history;
(h) marketing consent and withdrawal records; and
(i) device, technical and fraud-prevention information.
14.3 Joining the Program or accepting these Terms does not constitute consent to receive Marketing Communications.
14.4 Zamel’s will obtain marketing consent through a separate affirmative action.
Where email and SMS marketing are offered, Zamel’s will provide separate consent choices for each channel. Marketing consent options will not be pre-selected.
14.5 Zamel’s will maintain an auditable record of marketing consent, including, where reasonably practicable:
(a) the member or account to which the consent relates;
(b) the channel consented to;
(c) the wording and version of the consent statement;
(d) the date and time consent was given;
(e) the method and location through which it was given; and
(f) any subsequent withdrawal, suppression or change.
14.6 A member may withdraw consent to Marketing Communications at any time by:
(a) using the unsubscribe facility in the communication;
(b) replying STOP where that functionality is offered for SMS;
(c) updating available communication preferences; or
(d) contacting Zamel’s.
Zamel’s will action a valid withdrawal within five working days and will not require the member to pay a fee, create an account, log into an account or provide unnecessary additional personal information.
14.7 Withdrawing marketing consent:
(a) does not terminate membership;
(b) does not cancel Zamel’s Cash or another Program Benefit already issued;
(c) does not prevent the member from earning or redeeming Zamel’s Cash; and
(d) may mean the member does not receive promotional reminders by the withdrawn channel.
14.8 Zamel’s may send Service Communications without marketing consent where reasonably necessary to administer the member’s account, transaction or legal relationship with Zamel’s.
A Service Communication must not contain advertising or promotional content unless the member has consented to receive Marketing Communications through that channel.
14.9 If a member provides personal information about another person outside the referral process in clause 9, the member must have authority or another lawful basis to provide that information.
This clause does not transfer Zamel’s own privacy or electronic-marketing obligations to the member.

15. Australian Consumer Law
15.1 Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or protections that cannot be excluded, restricted or modified under the Australian Consumer Law or any other applicable law.
15.2 Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where required by law, members are entitled to remedies including repair, replacement, refund, cancellation and compensation for reasonably foreseeable loss or damage.
15.3 Program Benefits are provided in addition to, and do not replace, any rights or remedies members may have under the Australian Consumer Law.
15.4 Extended Care Plans and similar care plans are subject to separate terms and conditions. Those plans are additional to, and do not replace, rights and remedies under the Australian Consumer Law.
16. Liability
16.1 Nothing in these Terms excludes, restricts or modifies:
(a) the consumer guarantees, rights or remedies under the Australian Consumer Law;
(b) liability for fraud, wilful misconduct or negligence;
(c) liability arising from Zamel’s breach of applicable privacy or data-security obligations; or
(d) any other liability that cannot lawfully be excluded, restricted or modified.
16.2 Subject to clause 16.1 and to the extent permitted by law, Zamel’s is not liable for loss caused solely by:
(a) an event outside Zamel’s reasonable control;
(b) incorrect or outdated information provided by the member;
(c) the member’s failure to take reasonable steps to protect their Program Account; or
(d) unauthorised account access that was not caused or contributed to by Zamel’s breach, negligence or failure to take reasonable security precautions.
16.3 Clause 16.2 applies only to the extent that Zamel’s:
(a) took reasonable steps to prevent or minimise the relevant event or loss; and
(b) acted reasonably to correct the issue after becoming aware of it.
16.4 If a material failure of a Zamel’s system prevents a member from redeeming Zamel’s Cash before expiry, Zamel’s will, where the member was otherwise eligible to redeem it:
(a) reinstate the affected Zamel’s Cash; or
(b) extend its expiry for a reasonable period of not less than 30 days after the system becomes available.
16.5 To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the member joined or used the Program.
This clause does not limit compensation available under the Australian Consumer Law or another applicable law.
17. Program Changes, Suspension or Termination
17.1 Zamel’s may change the Program or these Terms where reasonably necessary to:
(a) improve or administer the Program;
(b) respond to changes in law, regulatory guidance or industry requirements;
(c) address fraud, misuse, security risks or material system errors;
(d) reflect changes to products, services, technology or participating sales channels; or
(e) maintain the commercial sustainability of the Program.
17.2 Where a proposed change is likely to have a material adverse effect on members, Zamel’s will provide at least 30 days’ prior notice by one or more of:
(a) email;
(b) SMS;
(c) a prominent website notice; or
(d) a notice displayed in the member’s Program Account.
A notice will describe the change, its effective date and any action the member may take.
17.3 Zamel’s may make a change without 30 days’ prior notice where immediate action is reasonably required:
(a) by law or a regulator;
(b) to address fraud or a material security risk;
(c) to correct a manifest system or calculation error; or
(d) to prevent material harm to Zamel’s, members or another person.
Zamel’s will provide notice as soon as reasonably practicable after making the change.
17.4 Unless clause 13 applies or a correction is required for a manifest error, a change will operate prospectively and will not:
(a) reduce the amount of valid Zamel’s Cash already issued;
(b) bring forward the expiry date of valid Zamel’s Cash already issued;
(c) retrospectively make an Eligible Purchase ineligible; or
(d) cancel a valid voucher or Program Benefit already issued.
17.5 If Zamel’s discontinues the Program, it will provide at least 60 days’ prior notice and allow members to redeem valid Zamel’s Cash during that period.
Zamel’s Cash that would otherwise expire during the notice period will remain valid until the end of that period.
A shorter period may apply only where immediate discontinuation is required by law, a regulator, a material security incident or circumstances genuinely outside Zamel’s reasonable control. In that case, Zamel’s will take reasonable steps to preserve or provide an equivalent remedy for valid accrued benefits.
17.6 A member who does not accept a material change may close their membership under clause 1.8.
17.7 The current version of these Terms, including its effective date, will be available on the Zamel’s website and on request from Customer Relations.
18. Governing Law
18.1 These Terms are governed by the laws of South Australia and applicable Commonwealth laws of Australia.
18.2 Nothing in these Terms restricts a member’s right to bring a claim before any court or tribunal of competent jurisdiction.
